NAIFA-SD Important SB 158 Updates

Senate Bill 158 creates an exemption process where medical providers do not have to submit preauthorization requests to health insurers. This is known as "gold carding".

Why oppose SB 158?

  1. Inserts government into business disputes: it creates a complex process for resolving exemption process disputes between insurers and providers and tells private businesses what to do. Providers and health insurers already contract with each other, they could manage a similar process through their private contracts.

  2. Increases Cost: Health insurers will not be able to review procedures, which will increase the likelihood of usage of those procedures and cost to insurers. Health insurers will pass increases in cost to citizens by increasing premiums.

  3. Improper use of existing process: attempts to use an existing process for insured claims disputes for the benefit of provider disputes.

  4. Ambiguous and confusing: this bill improperly uses common insurance terms. including the health insurers it applies to, resulting in confusion.
