It is hard to believe that Friday, February 7th ended the fourth week of the 2025 Legislative Session. It has been a busy session with a total of 488 bills introduced. Last week was a successful one for insurance. We saw the defeat of HB 1070 and HB 1112 in committee, HB 1102 was tabled at the request of the Prime Sponsor, and HB 1122 squeaked out of the committee, but went down on the House floor.
SB 158 (pre-auth/gold card bill) is still the elephant in the room and was scheduled for hearing this week. We just learned that it has been deferred to next week with a hearing on February 19th. Committee members are: Kevin Jensen; Sydney Davis (Prime Sponsor); Tamara Grove; Karl Perry; Tim Reed; Jamie Smith; and Curt Voight. Any grassroots assistance we can get is greatly needed and appreciated.
Following are the bills we are tracking: (Bills with a strikethrough have been defeated or modified in some manner.)
HB 1016: An Act to revise provisions related to pharmacy.
HB 1019: An Act to eliminate certain property taxes levied on owner-occupied single-family dwellings, and to increase certain gross receipt tax rates and use tax rates.
HB 1024: An Act to amend certain fees collected by the Secretary of State.
HB 1037: An Act to repeal the tax collection allowance credit for filing returns and remitting taxes electronically.
HB 1048: An Act to require that cash be accepted for certain transactions. Amendment 1048B was adopted in committee, which limited the requirement to accept cash to transactions of $100 or less.
HB 1058: An Act to prohibit the reporting of medical debt and to provide a penalty therefor.
HB 1061: An Act to prohibit a health care provider from restricting or denying a parent of guardian's access to certain medical records and other health information of a minor.
HB 1070: An Act to prohibit cost-sharing in certain health insurance policies for diagnostic and supplemental breast imaging examinations.
HB 1078: An Act to establish provisions related to the disclosure of COVID-19 vaccination status and blood donations.
HB 1097: An Act to establish and modify provisions for the temporary training of nonresident physicians.
HB 1098: An Act to make an appropriation to the Department of Human Services for reimbursing the cost of respite care services for caregivers of individuals with dementia and to declare and emergency.
HB 1101: An Act to repeal provisions related to medical marijuana.
HB 1102: An Act to require the submission of medical, dental, and pharmaceutical claims data to the Division of Insurance and to establish a health care data system.
HB 1111: An Act to make an appropriation for grants to support the purchase of telehealth kiosks.
HB 1112: An Act to require the coverage of biomarker testing in certain health insurance policies.
HB 1117: An Act to modify requirements on the use of mobile electronic devices while driving.
HB 1122: An Act to amend provisions of the Uniform Commercial Code.
HB 1137: An Act to establish provisions related to the treatment of pain with non-opioid drugs.
HB 1139: An Act to allow individualized investigative treatments for patients with life-threatening or debilitating diseases or conditions.
HB 1141: An Act to provide an exception for employers to acquire and distribute opioid antagonists that are available over the counter.
HB 1144: An Act to adopt the dietitian licensure compact.
HB 1146: An Act to require hospitals to implement drug testing programs.
HB 1152: An Act to prohibit the enforcement and implementation of directives from the United States Centers for Disease Control and intergovernmental organizations, and to provide a penalty therefor.
HB 1181: An Act to require a school district to provide dyslexia screening.
HB 1186: An Act to provide for the revision and eventual repeal of the employer's investment in South Dakota's future fee.
HB 1210: An Act to prohibit a hospital from reporting medical debt for collection in certain situations.
HB 1223: An Act to provide for conscience exemptions from certain medical treatments.
HB 1225: An Act to update and repeal provisions related to the reporting of hospital charge information.
HB 1233: An Act to provide hearing aids to children and make an appropriation therefor.
HB 1244: An Act to make certain federal laws applicable to public employees.
HB 1248: An Act to clarify informed consent requirements for the provision of prenatal and postnatal care to a minor.
HJR 5001: Proposing and submitting to the voters at the next general election an amendment to the Constitution of the State of South Dakota, conditioning the requirement of expanded Medicaid on the level of federal medical assistance.
SB 26: An Act to reduce employer contribution rates and increase the administrative fee rate for reemployment assistance.
SB 29: An Act to amend provisions regarding the Division of Insurance and the former Division of Securities operating fund.
SB 30: An Act to remove outdated provisions within the insurance code.
SB 60: An Act to expand the access and investigatory authority of the state auditor.
SB 87: An Act to address reauthorization requirements for certain health care services and utilization review requirements for certain health benefit plans. (This bill was withdrawn at the request of the prime sponsor and was replaced with SB 158).
SB 93: An Act to prohibit payment of rebate of insurance deductibles by contractors providing motor vehicle repair services.
SB 122: An Act to restrict the deference given by courts to a state agency's interpretation of a state statute, administrative rule, or policy.
SB 135: An Act to exempt a motor vehicle insurer from a certain title fee.
SB 154: An Act to prohibit pharmaceutical manufacturers and wholesale drug distributors from interfering in contracts between 340B entities and pharmacies and to provide a penalty therefor.
SB 158: An Act to address reauthorization requirements for certain health care services and utilization review requirements for certain health benefit plans. NAIFA opposes this bill.
SB 165: An Act to revise and repeal certain provisions related to the wearing of a safety seat belt and to provide a penalty therefor.
SB 182: An Act to require every permanent or emergency administrative rule proposal to receive the approval of an elected official before submission to the Legislative Research Council.
SB 186: An Act to establish standard time in this state.
SB 191: An Act to limit annual valuation increases on owner-occupied single-family dwellings.
SB 194: An Act to classify nicotine products as tobacco products, to increase tax rates on cigarettes and tobacco products, to create the healthcare workforce development fund, and to make an appropriation therefor.
SB 207: An Act to freeze property tax revenues and assessments for two years.
